Is it possible a title search does not reveal some items?

Yes, there is a possibility that certain items have been incorrectly recorded into public records, or failed to be recorded. A title search will only reveal what has been indexed into the documentation. Hence, it is of utmost importance to perform a professional title search and purchase the policy to protect your future ownership rights from occurrences from the past.

What is a title defect?

A title defect is an issue (or issues) with the chain of title that makes the property not fit for sale. Title defects refer to issues such as clerical error in public recordation, unresolved claims, outstanding debt, or hidden heirs. All of these defects must be resolved before the ownership can be transferred from one party to another.

How is a title defect cleared?

Once the defects are identified, the title company proceeds to clear the title by outlining their findings in a document called Title insurance Binder / Commitment. This document lists all the details of how the clearing will be conducted. Incorrect documents are corrected by supplying accurate ones. If there are liens or judgments on the property, they have to be settled first. The title company then uses the payment receipt for recordation and defect/lien removal.
